End User License Agreement (EULA)

This End User License Agreement ("Agreement" or "EULA") is a legally binding contract between you (the "User" or "you") and MurGoo.Click ("we", "us", or "our") for the use of the mobile application "MurGoo Search" (including all updates, local files, and documentation, collectively the "Software" or "App").

PLEASE READ THIS AGREEMENT CAREFULLY. BY INSTALLING, ACCESSING, OR USING THE SOFTWARE, YOU REPRESENT AND WARRANT THAT (I) YOU ARE AT LEAST 18 YEARS OF AGE (18+) AND HAVE THE LEGAL CAPACITY TO BIND YOURSELF TO THIS AGREEMENT, AND (II) YOU AGREE TO BE BOUND BY ALL TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE OR DO NOT MEET THESE REQUIREMENTS, DO NOT DOWNLOAD, INSTALL, OR USE THE SOFTWARE, AND IMMEDIATELY UNINSTALL IT FROM YOUR DEVICE.

1. Age Requirement Warranty (18+)

The Software is strictly intended for adult users. You represent, warrant, and covenant that you are at least eighteen (18) years of age. If you are under eighteen years old, you are strictly prohibited from using the Software. We expressly disclaim all liability associated with unauthorized access by individuals under the age of eighteen. You agree to hold us completely harmless from any claims arising from use by minors.

2. Free and Offline Utility (Zero Data Collection)

The Software is provided to you as a 100% free offline-first utility. The App conducts on-demand visual analysis, text extraction (OCR), and face auditing strictly locally on your device. We do not maintain remote cloud backends, we collect no user files or search query logs, and we transmit no analytics. All locally compiled indexes are saved inside your private device storage sandbox.

3. License Grant

Subject to your strict compliance with this Agreement, we grant you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use one copy of the Software on a single mobile device owned or controlled by you, solely for your personal, non-commercial purposes.

4. Restrictions on Use

You agree not to, and you will not permit others to:

License, sell, rent, lease, assign, distribute, host, outsource, disclose, or otherwise commercially exploit the Software.
Modify, translate, adapt, improve, or create derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Software.
Remove, alter, or obscure any proprietary notices.
Use the App to index, analyze, or process any images, files, or documents for which you do not possess legal authorization, ownership, or consent.
Use the App for any illegal, unlawful, or unauthorized purpose.

5. Optional Voluntary Support Tips

The App incorporates voluntary micro-tipping tiers powered by Google Play Billing to assist independent software updates. All payments are purely voluntary, do not unlock any premium features or exclusive deliverables, and are non-refundable except as governed by Google Play Store terms. We accept no liability for payment transactions handled by third-party processors.

6. User Content and Legal Compliance

You are solely responsible and liable for all images, files, and content that you process, index, or search using the Software. You explicitly agree that you will not use the Software to process or search any content that is illegal, illicit, infringes upon any third-party rights (including intellectual property, privacy, and publicity rights), or violates any applicable laws or regulations. Because the App operates entirely locally and offline, we have zero visibility into, control over, or access to your content. We bear absolutely no responsibility or liability for any illegal, offensive, explicit, or inappropriate content you may interact with, store, or process using the Software. You assume all risks associated with the content you process.

7. Accuracy of On-Device ML (ML & OCR Disclaimer)

The Software relies on local on-device machine learning algorithms (such as ML Kit libraries) to run image labeling, face detection, and Optical Character Recognition (OCR). You acknowledge and agree that these algorithms are probabilistic, experimental, and inherently imperfect. We do not represent, warrant, or guarantee that any tags, face counts, or extracted texts will be accurate, complete, reliable, or free from error. We bear no responsibility for any consequences resulting from inaccurate categorizations or text extractions. The Software must not be relied upon for critical, professional, legal, medical, or security-sensitive visual auditing.

8. User Responsibility for File Backups

The Software interacts with directories and local storage on your device. You are solely responsible for keeping independent, secure, and regular backups of all images, files, and folders analyzed or edited using the App. WE ACCEPT ZERO LIABILITY FOR ANY ACCIDENTAL DATA LOSS, FILE CORRUPTION, ERASURE, STORAGE CRASH, OR PERMANENT DELETION OF DATA ARISING FROM YOUR USE OF THE APP.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED TO YOU "AS IS", "AS AVAILABLE", AND "WITH ALL FAULTS", WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MURGOO.CLICK, ITS DEVELOPERS, AFFILIATES, AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL FUNCTION UNINTERRUPTED, SECURELY, OR ERROR-FREE, THAT ANY ERRORS WILL BE CORRECTED, OR THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY, RESULTS, AND PERFORMANCE OF THE SOFTWARE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MURGOO.CLICK, ITS DEVELOPERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF GOODWILL, LOSS OF DATA, DATA CORRUPTION, DEVICE FAILURE, HARDWARE DAMAGE, BUSINESS INTERRUPTION, PRIVACY COMPROMISE, OR ANY OTHER PECUNIARY OR NON-PECUNIARY LOSS ARISING OUT OF OR IN ANY WAY RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH THE SOFTWARE IS TO STOP USING AND UNINSTALL THE SOFTWARE. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED USD $1.00.

11. Indemnification

You agree to indemnify, defend, and hold completely harmless MurGoo.Click, its developers, affiliates, agents, and licensors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of, relating to, or resulting from: (a) your use or misuse of the Software; (b) your violation of any term of this Agreement; (c) your violation of any third-party rights, including intellectual property, privacy, or property rights; (d) any unlawful, illegal, or illicit images, documents, or content analyzed, stored, or processed by you using the Software; or (e) your violation of any applicable laws or regulations.

12. Class Action Waiver

YOU AGREE THAT ANY CLAIMS OR DISPUTES ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SOFTWARE MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

13. Severability & Entire Agreement

If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement shall remain in full force and effect. This Agreement constitutes the entire contract between us regarding the App and supersedes all prior representations or communications.

14. Governing Law & Jurisdiction

This Agreement and your use of the Software shall be governed by, construed, and enforced in accordance with the laws of India, without giving effect to any principles of conflicts of law. You explicitly agree that any legal action, dispute, or claim arising out of or relating to this license shall be submitted to the exclusive, personal jurisdiction of the competent courts in Panaji, Goa, India.
