End User License Agreement for MurGoo Screen Watermark

Please read this End User License Agreement ("Agreement") carefully before downloading, installing, or using the MurGoo Screen Watermark application ("Software"). By downloading or using the Software, you agree to be bound by the terms and conditions of this Agreement.

1. Age Restriction & Eligibility

This Software is intended for use solely by individuals who are eighteen (18) years of age or older (adults only). By downloading, installing, accessing, or using the Software, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into this binding Agreement. If you are under 18 years of age, you are strictly prohibited from using this Software, and you must immediately uninstall and delete all copies of the Software from your device.

MurGoo grants you a personal, revocable, non-exclusive, non-transferable, limited license to download, install, and use the Software solely for your personal, non-commercial, or professional broadcasting/streaming uses strictly in accordance with the terms of this Agreement.

The Software runs fully offline. All watermark rendering, custom overlay layers, camera whitelist evaluations, and exported JSON backup files are stored and computed locally on your device storage. MurGoo does not collect, transmit, or monitor your overlay presets, device logs, or screen contents.

5. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, MURGOO AND ITS DEVELOPERS MAKE NO REPRESENTATION OR WARRANTY THAT: (I) THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (II) THE SOFTWARE RENDERED OVERLAYS WILL BE COMPATIBLE WITH ALL MOBILE SCREENS OR OTHER ACTIVE APPLICATIONS; OR (III) THE AUTOMATIC PRIVACY AND SHUTTER APP RULES WILL PERFECTLY DETECT OR OBSCURE SENSITIVE CAMERA OR BANKING PORTAL DATA WITHOUT ERRORS, SINCE SYSTEM RELEASES OR USER ACCESSIBILITY CONSTRAINTS MAY IMPACT DETECTION ENGINE PERFORMANCE.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOU SOLELY ASSUME ALL RESPONSIBILITY AND RISKS ASSOCIATED WITH SCREEN USE. SPECIFICALLY, ALTHOUGH ACTIVE MOTION SYSTEMS AND ROTATIONS ARE OFFERED TO HELP MINIMIZE DISPLAYS STATIC FOOTPRINTS, MURGOO AND ITS DEVELOPERS DECLINE ALL LIABILITY AND RESPONSIBILITY FOR ANY SCREEN BURN-IN, STATIC OLED/AMOLED DEGRADATION, COLOR RETENTION, OR HARDWARE DISTORTION THAT MAY ARISE ON YOUR DEVICE ASSOCIATED WITH OVERLAY RENDERING.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW (INCLUDING THE INFORMATION TECHNOLOGY ACT, 2000), IN NO EVENT SHALL MURGOO, ITS DEVELOPERS, AFFILIATES, OR REPRESENTATIVES BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BROADCAST REVENUES, PRIVATE DATA BREACH, LOSS OF BRAND REPUTATION, INTELLECTUAL PROPERTY INFRINGEMENT, DEVICE CRASHES, OR BUSINESS INTERRUPTION) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE.

IN ANY CASE, THE ENTIRE LIABILITY OF MURGOO AND ITS DEVELOPERS UNDER ANY PROVISION OF THIS AGREEMENT AND YOUR EXCLUSIVE REMEDY FOR ALL OF THE FOREGOING SHALL BE STRICTLY LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE SOFTWARE OR A NOMINAL RECOVERY SUM OF RS. 100 INR (ONE HUNDRED INDIAN RUPEES), WHICHEVER IS LOWER.

7. Indemnity

You agree to indemnify, defend, and hold harmless MurGoo and its developers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) that arise from your use of the Software, violation of this Agreement, or infringement of any third-party intellectual property or content rights via the custom texts or images you select to render on screen.

8. Governing Law & Dispute Resolution

This Agreement and your use of the Software shall be governed by, and construed in accordance with, the laws of the Republic of India, without regard to its conflict of law principles.

You explicitly agree that any legal action, dispute, or proceeding arising out of or relating to this Agreement or the Software shall be subject to the sole and exclusive jurisdiction of the competent courts located in Panaji, Goa, India.

9. Termination

This Agreement shall remain in effect until terminated by you or MurGoo. MurGoo may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
