EULA Terms and Agreement

Please read this End User License Agreement ("Agreement") carefully before downloading, installing, or using the MurGoo Click Tester mobile application ("Application").

By downloading or using the Application, you are agreeing to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not download, install, or use the Application.

1. License Grant & Age Requirement

Age Requirement: You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use this Application. By downloading, installing, or using the Application, you represent and warrant that you meet this age requirement. If you do not meet this requirement, you must immediately uninstall and cease all use of the Application.

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with the terms of this Agreement. This license is solely for personal, educational, non-commercial developer-testing, and diagnostics evaluation purposes.

2. Restrictions

You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, host, outsource, disclose, or otherwise commercially exploit the Application.
• Decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the Application.
• Modify, adapt, improve, enhance, translate, or create derivative works from the Application.

3. Intellectual Property

The Application, including without limitation all copyrights, patents, trademarks, source code, visual designs, assets, and other intellectual property rights, shall remain the sole and exclusive property of MurGoo Click Tester and its legal licensors.

4. Restyled Control Modifications

Users may customize their diagnostic environment (transition sliders, primary theme color, and vibration cues) using the build settings interface. Any configurations saved locally remain under your property and reside purely inside sandboxed hardware files.

5. Supporting Developer & In-App Donations

Users may optionally complete payments or purchase digital tips inside the application using Google Play Billing. Any such transactions constitute voluntary financial contributions to support the developer's continuation of free diagnostic utilities. These digital transactions are strictly final, handled securely by Google Play under their Terms of Service, and do not convey any ownership, intellectual property rights, or additional express warranties.

6. Diagnostic Data & Sharing Exports

If you choose to export click metrics, event transcripts (as HTML files), or capture screenshot images within the application, you do so completely under your own volition. You agree that shared materials representing touch records or custom calibration parameters are exported at your sole discretion. We brandish no control over and hold no liability for content shared once it exists outside the local runtime memory of the device.

7. Hardware Polling & OS Integrations

The application provides local shortcuts (Widgets and Quick Settings Tiles) and fetches screen orientation constraints (Density, Refresh Rate, Resolution). These integrations do not represent an intent to monitor your device outside the primary application context and are completely disconnected from remote telemetry.

8. Health & Safety Warning

REPETITIVE STRAIN INJURY (RSI) WARNING: The Application includes a "CPS (Clicks Per Second) Test" which encourages rapid tapping. Extended periods of rapid tapping can lead to muscle fatigue, tendonitis, or Repetitive Strain Injury (RSI) in your fingers, hands, wrists, or arms. You are advised to take frequent breaks. If you experience discomfort, pain, throbbing, aching, tingling, numbness, or stiffness in your hands or arms, stop using the application immediately and consult a medical professional. We disclaim all liability for any physical or physiological injuries resulting from the use of the Application.

PHOTOSENSITIVITY/SEIZURE WARNING: The Application includes a "Dead Pixel Tester" feature that allows users to rapidly cycle through bright, full-screen color variations. A small percentage of individuals may experience epileptic seizures or blackouts when exposed to certain light patterns or flashing lights. If you, or anyone in your family, has an epileptic condition or has had seizures of any kind, consult your physician before using this feature. Discontinue use immediately and consult a physician if you experience any adverse symptoms. We completely disclaim any liability for adverse health events resulting from the use of the Application's visual testing capabilities.

9. Disclaimer of Warranties & Limitation of Liability

To the maximum extent permitted by applicable law, the Application is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. Under no circumstances shall we be liable for any special, incidental, indirect, or consequential damages (including, but not limited to, damages for loss of profits, loss of data, loss of digital assets, financial disruption, or other pecuniary loss), including but not limited to screen wear-and-tear, pixel fatigue, touch-sensor calibration drifts, hardware fractures, or hardware fatigue resulting from high-frequency manual testing operations.

Because this application functions as a manual diagnostic and touch calibration utility, you agree never to deploy it within medical devices, life-support hardware, aviation control, or other mission-critical equipment. Furthermore, in no event shall our total aggregate liability to you for all damages, losses, and causes of action exceed the amount you actually paid for the Application, or one US dollar ($1.00), whichever is greater.

10. Acceptable Use Policy & Third-Party Environments

You remain solely and completely responsible for how you use this diagnostic tool. While this application only measures and logs manual screen interactions and does not contain any auto-clicking or automation functionality, if you employ this utility alongside other software or devices in third-party games, services, or platforms, you are entirely responsible for complying with their respective Terms of Service. We expressly disclaim any and all liability for account suspensions, bans, restrictions, loss of in-game currency, financial losses, or user restriction penalties.

11. Indemnification

You agree to indemnify, defend, and hold harmless the developer(s), its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your device/account) violation of this Agreement or your use of the Application's diagnostic and performance testing features.

12. Term and Termination

This Agreement shall remain active until terminated by you or us. Your limited license under this Agreement ceases immediately and automatically if you fail to satisfy any covenant or condition written herein. Upon termination, you must cease all usage of the software and uninstall the Application from your hardware devices.

13. Dispute Resolution, Arbitration, and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to this Agreement, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively by binding, individual arbitration, rather than in court. YOU AND WE AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

14. General Provisions (Severability & Integration)

If any provision of this Agreement is held to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to reflect the parties' intention as closely as possible and interpreted to accomplish the objectives of the provision to the greatest extent possible under applicable law. The remaining provisions will continue in full force and effect. This Agreement constitutes the entire agreement between you and the developer regarding your use of the Application.

15. Contact Us
